Terms of Service

1. Acceptance of terms

By accessing or using ArkonSwap ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users who access the Service.

2. Description of service

ArkonSwap is a front-end interface that allows users to initiate cross-chain cryptocurrency swaps using our non-custodial swap infrastructure. ArkonSwap does not operate its own blockchain infrastructure, execute trades independently, or act as a custodian of user funds at any time.

Swaps are executed via ArkonSwap's non-custodial infrastructure provider, whose automated, pattern-based AML screening applies to all transactions (see Section 8 and our FAQ for details, including how XMR swaps are routed).

3. Non-custodial nature

ArkonSwap is strictly non-custodial. This means:

• ArkonSwap never holds, controls, or has access to your private keys
• ArkonSwap never takes custody of your funds
• Deposit addresses are generated by ArkonSwap's infrastructure and funds flow directly on-chain
• You are solely responsible for the security of your own wallet and private keys

Because ArkonSwap is non-custodial, it cannot reverse or modify a transaction once it has been submitted to the blockchain. The only exception to uninterrupted execution is the upstream compliance layer described in Section 2, which can pause a swap before on-chain execution; ArkonSwap itself has no ability to pause, freeze, or redirect funds.

4. Eligibility

By using the Service, you represent that:

• You are of legal age in your jurisdiction to enter into binding contracts
• You are not located in, or a resident of, a jurisdiction where cryptocurrency swaps are prohibited by law
• You are not subject to economic or trade sanctions
• Your use of the Service complies with all applicable local, national, and international laws

It is your responsibility to verify whether using a non-custodial cryptocurrency swap service is legal in your jurisdiction.

5. Prohibited use

You agree not to use the Service to:

• Launder money or finance illegal activities
• Circumvent economic sanctions or trade embargoes
• Conduct fraudulent transactions or deceive other parties
• Exploit, hack, or interfere with the Service's infrastructure
• Use automated tools to interact with the Service in ways that degrade performance

Any violation may result in your transactions being frozen by automated compliance systems, with funds returned to the origin address subject to network fees.

6. Risks

Cryptocurrency swaps carry inherent risks that you acknowledge by using the Service:

• Price volatility — exchange rates can change between quote and execution
• Network failures — blockchain congestion may delay or fail transactions
• Slippage — actual output may differ from the quoted estimate
• Wrong address — funds sent to an incorrect destination address are unrecoverable
• Wrong network — sending on the wrong chain triggers a refund process with network fees deducted
• Smart contract risk — underlying protocols may contain unforeseen vulnerabilities

You use the Service at your own risk. ArkonSwap is not liable for any losses resulting from these risks.

7. Fees

ArkonSwap may charge an integrator fee to cover infrastructure and operational costs. All applicable fees are displayed on the quote confirmation page before you commit to a swap. Fees are non-refundable once a swap has been successfully executed.

8. Refunds

Refunds are handled automatically by ArkonSwap's infrastructure. A refund may occur in the following cases:

• A transaction fails AML compliance screening
• All swap routes are rejected by liquidity providers
• Funds are received on the wrong chain (requires you to submit a refund address)

Refunds are returned to the originating address minus applicable network fees.

9. Limitation of liability

To the maximum extent permitted by applicable law, ArkonSwap, its operators, and contributors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: loss of funds, loss of profits, transaction failures, or data loss.

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities.

10. Modifications

ArkonSwap reserves the right to modify these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new terms.

11. Governing law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from the use of the Service shall be resolved through good-faith negotiation before resorting to formal legal proceedings.
